Many foreign nationals living in the Czech Republic do not realize that an incorrect marital status in Czech government databases can create problems later, especially when applying for Czech citizenship by residency.
Although you may provide the Czech Ministry of Interior (Ministerstvo vnitra) with a marriage certificate or other civil status document, your marital status may not always be updated automatically in the government systems or the case worker may forget to do so. Failing to ensure that your records are correct can potentially affect your Czech citizenship application later down the road, which is why a Czech marrital status update is crucial.
How Marital Status Is Recorded in Czech Government Systems
Foreign nationals who hold a Czech visa or residence permit appear in several government information systems, including:
- Population Register (Registr obyvatel – ROB)
- Foreigners’ Information System (Agendový informační systém cizinců – AISC)
These databases contain important personal information, including your current marital status.
The marital status categories recorded in the Czech Republic include:
- Single (svobodný/svobodná)
- Married (ženatý/vdaná)
- Partnership or Registered Partnership (partnerství/registrované partnerství)
- Divorced (rozvedený/rozvedená)
- Widowed (vdovec/vdova)
When your marital status changes, for example after marriage, divorce, or the death of a spouse, you are required to notify the Czech Ministry of Interior and provide the relevant supporting documents.
For a foreign document, this generally means submitting:
- The original civil status document (for example, a marriage certificate or divorce decree)
- Any required legalization or apostille
- A certified Czech translation by a court translator
Why Your Records May Not Be Updated Automatically
Recently, we have observed cases where foreign nationals submitted their marriage certificate to the Ministry of Interior during a residence procedure, but their marital status remained incorrectly recorded as “single” in Czech government databases.
This situation often occurs when a foreign national:
- Arrived in the Czech Republic as a single person,
- Obtained a residence permit for another purpose (such as employment, business, or study),
- Later got married,
- And subsequently applied for family reunification or an EU family member residence permit.
Even though the marriage certificate was provided during the residence procedure, the database record was not always updated unless the applicant specifically requested the change.
Why can an incorrect marital status cause problems with Czech citizenship?
An incorrect marital status may seem like a minor administrative issue, but it can become important when applying for Czech citizenship based on permanent residence.
Under Section 14(6) of Act No. 186/2013 Coll., on the Acquisition of Czech Citizenship, an applicant may be refused Czech citizenship if they have seriously breached obligations arising from the Czech Act on the Residence of Foreign Nationals.
One of the obligations of foreign nationals residing in the Czech Republic is to report changes to their personal information, including changes in marital status.
Therefore, even if the mistake was partly caused by the Ministry of Interior not updating the record correctly, an outdated marital status in official databases may raise questions during a Czech citizenship application.
How can you check whether your marital status is correct?
Before submitting an application for Czech citizenship, we recommend checking that your personal information is correctly recorded in the Czech government systems.
One way to do this is to request an extract from the Population Register (výpis z Registru obyvatel) and verify that your marital status is correctly listed.
If you discover an error, it is better to request a correction before submitting your citizenship application rather than waiting until the Ministry of Interior reviews your file. Why? The Ministry will then have a reason to reject your citizenship application.
